Clinic registration by state
Clinic registration Maharashtra: the 1949 Act The nursing homes law, who registers, the three-year certificate, and the 2026 Bill that would reach single-doctor clinics.
Clinic registration in Maharashtra still runs under the Maharashtra Nursing Homes Registration Act, 1949, which registers premises that receive patients for treatment and nursing. A single-doctor OPD clinic with no beds does not fit that definition on its words. A Bill introduced on 3 July 2026 would change that by naming the single doctor's clinic.

- Section 2(4) defines a nursing home as premises for "the reception of persons suffering from any sickness, injury or infirmity and the providing of treatment and nursing for them", including a maternity home.
- Running an unregistered nursing home carries imprisonment up to six months, a fine up to ₹1 lakh, or both (section 6, as amended with effect from 31 Dec 2025).
- The Maharashtra Clinical Establishments (Registration and Regulation) Bill, 2026 covers a clinic "maintained by a single doctor" and would repeal the 1949 Act once it commences.
If you run a single-doctor OPD clinic in Maharashtra with no beds, the state's registration law for private health premises does not, on its text, reach you today. That law is the Maharashtra Nursing Homes Registration Act, 1949 (originally the Bombay Nursing Homes Registration Act). It registers nursing homes and maternity homes. The central Clinical Establishments Act, 2010 has not been adopted in Maharashtra; our state list shows where it applies.
Which law governs clinic registration in Maharashtra?
The Maharashtra Nursing Homes Registration Act, 1949, in the government's consolidated text as on 31 December 2025. Section 3 says: "No person shall carry on a nursing home unless he has been duly registered in respect of such nursing home". Section 18 keeps out nursing homes run by the government, a local authority or a body the state approves.
A replacement is pending. The Maharashtra Clinical Establishments (Registration and Regulation) Bill, 2026 (L.A. Bill No. LI of 2026) was "introduced in the Maharashtra Legislative Assembly on the 3rd July 2026", according to the Gazette translation published that day. Clause 54(1) repeals the 1949 Act from the date the new Act commences. We did not find an official record of the Bill being passed by 31 October 2026, so the 1949 Act is the law this page describes.
Does a single-doctor OPD clinic need to register?
Under the 1949 Act, not if it has no beds and nurses no one. Section 2(4) reads:
"nursing home" means any premises used or intended to be used, for the reception of persons suffering from any sickness, injury or infirmity and the providing of treatment and nursing for them and includes a maternity home; and the expression "to carry on a nursing home" means to receive persons in a nursing home for any of the aforesaid purposes and to provide treatment or nursing for them
The test is reception plus treatment and nursing. A consulting room where patients are examined, given a prescription and sent home is outside those words. Add a day-care bed, an observation room or any procedure where a patient stays under nursing care, and you move towards the definition. If you are unsure, write to your local supervising authority and keep the reply.
The 2026 Bill draws the line differently. Its clause 2(e) defines a clinical establishment as "a hospital, maternity home, nursing home, day care centre, dispensary, clinic, sanatorium or an institution by whatever name called" that offers diagnosis, treatment or care "established and administered or maintained by a single doctor, any person or body of persons". If it becomes law in that form, a bedless clinic would need registration.
Who registers a nursing home in Maharashtra?
The local supervising authority, which section 2(2) fixes by area:
- Municipal Corporation area: the Health Officer of that Municipal Corporation
- Municipal Council area: the Civil Surgeon of the district
- Cantonment: the Health Officer of the Cantonment
- Anywhere else: the District Health Officer of the Zilla Parishad
Section 4(2) leaves the form, the date and the fee to the rules, and section 16(2)(b) lets the state set different fees by area, number of beds and number of specialisations. We did not find a current statewide fee schedule on an official site, so ask your municipal corporation or Civil Surgeon's office for the amount that applies to you.
How long is registration valid?
Until 31 March of the third year after issue or renewal. Section 5(2) says the certificate "shall be valid until the 31st day of March of the third year next following the date on which such certificate is issued or renewed". The 1949 Act has no provisional stage. The 2026 Bill adds one: clause 17 makes a provisional registration valid "to the last day of the sixth month from the date of issue".
| Premises | Registration | Validity | Fee |
|---|---|---|---|
| Bedless single-doctor OPD clinic | Not within section 2(4) on its words | Not applicable | Not applicable |
| Nursing home or maternity home | Certificate from the local supervising authority (s. 5) | To 31 March of the third year (s. 5(2)) | Set under the rules; ask the authority |
| Government or local authority home | Outside the Act (s. 18) | Not applicable | Not applicable |
How do you register a nursing home in Maharashtra?
- Confirm which local supervising authority covers your address under section 2(2).
- Collect the prescribed application form and current fee from that office or its online service.
- Apply before you start, and before the certificate runs out each cycle, with the documents the authority lists.
- Allow inspection: section 9 lets the authority's officer enter the premises and check the records the Act requires.
- Display the certificate "in a conspicuous place in the nursing home" as section 5(3) requires.
Section 5 lets the authority refuse if the home is not managed by a resident person holding a degree in medical sciences, lacks the prescribed proportion of qualified nurses, is smaller than the prescribed area or has more beds than prescribed. Read those grounds before you sign a lease.
What is the penalty for running unregistered?
Section 6, as amended by Maharashtra Act 56 of 2025 from 31 December 2025, reads: "Whoever contravenes the provisions of section 3, shall, on conviction, be punished with imprisonment which may extend to six months or with fine which may extend to one lakh rupees or with both." Obstructing an inspection or giving false records carries up to six months or ₹50,000 under section 9(2).
What else does a Maharashtra clinic need?
Registration with your state medical council comes first; see state medical councils. Most clinics also deal with the municipal shop and establishment process, fire safety and trade licensing: see our posts on the shop and establishment licence and fire NOC and trade licence. Any clinic producing sharps or soiled dressings needs bio-medical waste authorisation; our bio-medical waste guide covers it. The full checklist is in documents required to open a clinic.

Visit records stay in one place and the clinic admin can export everything as CSV, which helps if the 2026 Bill brings record-keeping duties to OPD clinics. See clinic registration in India.
Questions
Is the Clinical Establishments Act 2010 applicable in Maharashtra?
No. Maharashtra has not adopted it. Private nursing and maternity homes register under the Maharashtra Nursing Homes Registration Act, 1949, and a state Bill of 2026 proposes a new clinical establishments law.
Do I need nursing home registration for a clinic with one observation bed?
Possibly. The 1949 Act turns on receiving patients and providing treatment and nursing for them. If patients stay under nursing care on that bed, ask your local supervising authority in writing.
Who is the registering authority in a municipal corporation area?
The Health Officer of that Municipal Corporation, under section 2(2)(i) of the 1949 Act.
Has the Maharashtra Clinical Establishments Bill 2026 become law?
It was introduced in the Legislative Assembly on 3 July 2026. We did not find an official record of its passing by 31 October 2026.
