Clinic registration by state

Clinic registration Himachal Pradesh: CE Act guide Who must register, provisional renewal every year, fees, and what the CAG found.

Clinic registration in Himachal Pradesh runs under the central Clinical Establishments Act, 2010, which has applied to the state from the start, and the Himachal Pradesh rules of 2012. Every clinic, including a single-doctor OPD, takes provisional registration from the District Registering Authority and renews it every year. The provisional fee for an OPD clinic is ₹500.

In short
  • Section 1(2) of the Act names Himachal Pradesh as one of four states where it applied "in the first instance", without a state resolution.
  • The state fee schedule lists ₹500 provisional for an out-patient or single-doctor clinic, and ₹3,000 (urban) or ₹1,500 (rural) for permanent registration.
  • A 2024 CAG audit found that, as of January 2024, the state had not started permanent registration, so provisional registration has to be renewed every year.

To register a clinic in Himachal Pradesh you apply to the District Registering Authority for provisional registration under the Clinical Establishments (Registration and Regulation) Act, 2010 and the Himachal Pradesh Clinical Establishments (Registration and Regulation) Rules, 2012. The certificate comes within ten days, without an inspection, and lasts to the end of the twelfth month, so you renew it each year. Permanent registration exists in the Act, but the state told the CAG in January 2024 that it had not yet started it.

Which law applies to clinics in Himachal Pradesh?

The central Clinical Establishments Act, 2010, directly. Section 1(2) says it "applies, in the first instance, to the whole of the States of Arunachal Pradesh, Himachal Pradesh, Mizoram and Sikkim and the Union territories", so Himachal did not need to pass an adoption resolution. Section 1(3) left the start date to a central notification; the Uttarakhand High Court, in a 2017 judgment, recorded that the Centre fixed 1 March 2012 for these four states and the union territories. The state rules were made under section 54 by notification no. HFW-B(B)1-10/2012 of 20 December 2012. Our states list covers the rest of India.

Does a single-doctor clinic have to register in Himachal Pradesh?

Yes. Section 2(c) of the Act includes a clinic owned or managed by "a single doctor", in "any recognised system of medicine", and excludes only Armed Forces establishments; section 11 bars running one without registration. The state rules say they apply "to all the Clinical Establishments in the State", and the application form lists "Single practitioner" as an ownership type. The CAG's 2024 audit of the state's health services describes the Act as applicable to all recognised systems of medicine, "including single doctor clinics". Government establishments register but pay no fee (rule 23(ii)).

A laboratory or diagnostic centre that is part of a clinic giving out-patient or in-patient care needs no separate registration (rule 19(iii)), though the rules' fee annexe adds that "fee as applicable above would have to be paid".

How do you register a clinic in Himachal Pradesh?

  1. Fill the SG1-A application form in the 2012 rules: clinic and owner details, system of medicine, services, staff and infrastructure.
  2. File it with the District Registering Authority "either in person, or by post or through web based online facility" (rule 19(i)). In January 2024 the state told the CAG that registration and renewal run through the Government of India portal.
  3. Pay the fee in cash, by demand draft or online in favour of the authority (rule 23(iv)). The form also lists postal order.
  4. Keep the acknowledgement; an online application generates one automatically (rule 20).
  5. Receive the provisional certificate within ten days. The authority makes no enquiry first (rule 21; section 16(1) of the Act).
  6. Display it "in a conspicuous place" (section 18), and diary the renewal: apply thirty days before the twelve months run out (rule 25(i)).

Rule 19(ii) says clinics apply for permanent registration "Once the process for permanent registration is started by the State". The CAG reported that the Government of India asked the state to begin in April 2016, and that the process "was yet to be initiated till date (January 2024)". We did not find a later state notice; ask your district authority whether permanent registration is open now. For papers to keep ready, see our documents checklist.

How long is registration valid, and what does it cost?

Provisional registration is valid "to the last day of the twelfth month from the date of issue" and is renewable (section 17). If you renew late, rule 25(i) adds a penalty of ₹100 per month. A permanent certificate, once available, lasts five years (section 30(2)) and must be renewed six months before expiry, with a late penalty of ₹100 per day (rule 25(v)). The fees below are from the Himachal schedule on the Ministry's portal, read 31 Oct 2026.

The renewal and late-fee rows come from the fee annexe to the 2012 rules, which also lists ₹200 for a duplicate certificate and ₹1,000 for a change of ownership, management or name. A change of owner must be reported within one month (rule 24(ii)). Other states are compared in clinic registration fees by state.

What must the OPD desk display and keep?

  • The registration certificate, where every visitor can see it (section 18 of the Act).
  • A rate list. Rule 9(i) of the Clinical Establishments (Central Government) Rules, 2012 asks for the rates of each service at a conspicuous place in the local language and English. The CAG found charges not displayed in 18 of the 23 private clinics it visited.
  • Records and statistics for three years, with three-monthly reports to the district authorities (rule 28 of the state rules).
  • Bio-medical waste authorisation from the State Pollution Control Board; see our bio-medical waste guide.

What is the penalty for running an unregistered clinic?

Section 41(1) of the Act sets a monetary penalty of up to ₹50,000 for a first contravention, ₹2 lakh for a second and ₹5 lakh for any later one; section 41(2) adds up to ₹25,000 for knowingly working in an unregistered clinic. The Jan Vishwas (Amendment of Provisions) Act, 2026, in force for this Act since 22 June 2026 (S.O. 3273(E)), changed the fines in sections 40, 43 and 46 into penalties decided by the authority and left section 41(1) unchanged. Lapsed renewals are a real risk here: in the CAG's site visits, 11 of 23 private clinics and hospitals were running without renewing provisional registration.
