Professional indemnity insurance meaning in India How IRDAI describes the cover, what it usually includes and excludes, and the terms to read in a policy.

Professional indemnity insurance pays for claims that a professional's error, omission or negligence caused a client loss, and for the cost of defending those claims. This entry uses only IRDAI's own description of the product; it does not compare or recommend insurers.

In short
  • An IRDAI committee report calls a professional indemnity policy "a legal liability policy that covers financial loss suffered by the client/s resulting from breach of professional duty".
  • The same report says it "also covers legal expenses incurred in defence of the civil suits", and lists claims from contractual liability, terrorism and criminal acts as instances not covered.
  • The standard form IRDAI's committee drafted for insurance intermediaries is "Claims made" and carries a retroactive date; read both terms in any policy schedule.

Professional indemnity insurance is, in the words of an IRDAI committee report, "a liability insurance product that protects individuals giving professional advice as well as professional entities who are service providers, against negligence claims by their clients for the errors and omissions that the professionals might make and for damages awarded in a civil lawsuit". For a doctor the client is the patient, and the professional entity can be the clinic. The policy pays, up to its limit, what the insured is held liable to pay and the cost of defending the case, subject to its exclusions.

What is professional indemnity insurance?

Liability cover for mistakes in professional work. The IRDAI report opens: "Professionals and professional entities may be sued by their clients for errors or negligence during the course of their professional duties. To cover such risks, one may opt for a professional indemnity policy." It adds that the cover can extend beyond negligence to "unintentional breaches of confidentiality, loss of documents, loss of database etc.", and that it "also covers legal expenses incurred in defence of the civil suits filed on these aspects".

Where does the definition come from?

From the Report of the Committee for Standardization of Professional Indemnity Insurance Policy for Insurance Intermediaries, submitted to IRDAI on 19 October 2020. The committee was set up by IRDAI order IRDA/INT/ORD/MISC/103/05/2020 of 4 May 2020 to draft a standard policy for insurance brokers and other intermediaries, so its rules on limits and retroactive dates are written for them, not for doctors. Its chapter I description of the product is general and is the clearest regulator text we found. The IRDAI documents we read do not set a compulsory professional indemnity cover for doctors or clinics.

What it means for a small clinic

Take Sunrise Clinic, a sample OPD run by one doctor with a front desk and a nurse. The doctor's own policy and a policy in the clinic's name are different things, so check whose name is on the schedule and whether employees are included. On a claims-made form, the claim generally has to be made while the policy is in force, which is why an unbroken renewal and an early retroactive date matter. Keep the schedule, the policy wording and every renewal receipt in one folder. Our guide to professional indemnity insurance for doctors goes through buying and claims in more detail.

Questions

What does professional indemnity insurance cover?

IRDAI's committee report describes it as covering negligence claims for errors and omissions, damages awarded in a civil lawsuit, and the legal expenses of defending those suits.

What does it usually not cover?

The IRDAI report gives claims arising out of contractual liability, terrorism and criminal acts as examples. Each policy lists its own exclusions.

Is professional indemnity insurance compulsory for doctors in India?

The IRDAI documents we read make it compulsory for insurance intermediaries, not for doctors. Check with your state council and any hospital you attach to.

What is a retroactive date?

A date set in the policy schedule. In the IRDAI standard form for intermediaries it is the date IRDAI issued the licence, and a higher limit bought at a later renewal carries the later date as its retroactive date. Ask your insurer how your own policy uses it.
