Compliance

Medical certificate rules for doctors in India The register, the form, sick leave and fitness, government staff, and false certificates.

A sick-leave note takes two minutes to write and is the document most likely to bring a doctor before the state medical council or a court. We read the clauses, forms and penal sections that apply to a medical certificate issued from a private OPD, and put them in the order you meet them at the desk.

In short
  • Clause 1.3.3 of the 2002 conduct regulations requires a Register of Medical Certificates, a copy of every certificate, and the patient's signature or thumb mark, address and at least one identification mark on it, in the Appendix 2 form. Clause 1.4.1 puts your registration number on every certificate.
  • Under clause 7.7, a doctor who signs a certificate that is "untrue, misleading or improper" is liable to have their name deleted from the register. Section 234 of the Bharatiya Nyaya Sanhita, 2023 punishes issuing or signing a certificate known or believed to be false in any material point "in the same manner as if he gave false evidence".
  • For central government employees, rule 19 of the CCS (Leave) Rules, 1972 decides who may certify. A registered medical practitioner's certificate in Form 4 counts only in the cases the rule lists; a fitness certificate to rejoin is Form 5 under rule 24(3).

Short answer: a doctor in India issues a medical certificate under the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002, which the NMC applies today. You must keep a register of every certificate with a copy (clause 1.3.3), use the Appendix 2 form, record the patient's signature or thumb mark, address and an identification mark, and print your registration number (clause 1.4.1). A certificate that is "untrue, misleading or improper" can cost you your registration (clause 7.7), and one you know is false is an offence under section 234 of the Bharatiya Nyaya Sanhita, 2023. Government employers can add their own forms; for central government staff that is the CCS (Leave) Rules, 1972.

Our NMC professional conduct guide lists these clauses alongside the rest of the code. This post goes deeper on certificates only: what to record, what the form says, where sick leave and fitness certificates differ, what a central government office will accept, and where a certificate becomes a crime.

Which rules govern a medical certificate?

Rules that apply to a medical certificate issued from a private clinic (checked 26 Oct 2026)
RuleWhat it coversApplies to
IMC Regulations 2002, clause 1.3.3 and Appendix 2Register of certificates, copy, patient identification, the formEvery registered medical practitioner
IMC Regulations 2002, clause 1.4.1Registration number on every certificateEvery registered medical practitioner
IMC Regulations 2002, clause 7.7 and Appendix 4Untrue, misleading or improper certificates as misconduct; list of certificate typesEvery registered medical practitioner
CCS (Leave) Rules 1972, rules 19 and 24, Forms 4 and 5Who may certify sick leave and fitness for central government staffCertificates for central government employees covered by those rules
Bharatiya Nyaya Sanhita 2023, sections 234 and 235Issuing, signing or using a false certificateAnyone, including the doctor and the patient

Appendix 4 of the 2002 regulations lists the certificates, reports and notifications doctors issue "for the purposes of various Acts / Administrative requirements". Item (m) is the one a clinic sees daily: "For excusing attendance in courts of Justice, in public services, in public offices or in ordinary employment." Others on the list include certificates under the Employee's State Insurance Act, for passports, for driving licences and under the Acts relating to birth and death. Clause 7.7 names these as documents doctors sign "in their professional capacity for subsequent use in the courts or for administrative purposes", which is why the misconduct rule applies to all of them.

What must go in the register of medical certificates?

Clause 1.3.3 reads in full: "A Registered medical practitioner shall maintain a Register of Medical Certificates giving full details of certificates issued. When issuing a medical certificate he / she shall always enter the identification marks of the patient and keep a copy of the certificate. He / She shall not omit to record the signature and/or thumb mark, address and at least one identification mark of the patient on the medical certificates or report. The medical certificate shall be prepared as in Appendix 2."

That gives four duties: keep a register, keep a copy, put the identifiers on the certificate, and use the Appendix 2 form. The clause asks for "full details of certificates issued" without listing columns. A register that lets you answer a council query or a court summons usually carries:

  • a running serial number, also written on the certificate itself;
  • the date of issue;
  • the patient's name, address and identification marks, as on the certificate;
  • the type of certificate (leave, extension, fitness, other) and who it is addressed to, if the patient says;
  • the illness and the period certified, or the date from which the patient is fit;
  • a pointer to the visit record for that day, so the examination behind the certificate can be found.

Clause 1.3.3 does not set how long to keep the register. Clause 1.3.1's three-year period is written for indoor patient records. Most clinics keep the certificate register and copies at least as long as their other records; our post on how long to keep medical records covers the periods that do exist and what to do with a copy request.

What does the Appendix 2 certificate form say?

Appendix 2 is headed "Form of certificate recommended for leave or extension or communication of leave and for fitness". It has a signature or thumb impression line for the patient, "To be filled in by the applicant in the presence of the Government Medical Attendant, or Medical Practitioner", and two lines for identification marks. Then two certifying paragraphs:

I, Dr. ______ after careful examination of the case certify hereby that ______ whose signature is given above is suffering from ______ and I consider that a period of absence from duty of ______ with effect from ______ is absolutely necessary for the restoration of his health.

Appendix 2, leave certificate paragraph

I, Dr. ______ after careful examination of the case certify hereby that ______ on restoration of health is now fit to join service.

Appendix 2, fitness paragraph

The foot has place, date, "Signature of Medical attendant" and "Registration No.", with the issuing council named: "Medical Council of India / State Medical Council of ………. State". A note adds: "The nature and probable duration of the illness should also be specified. This certificate must be accompanied by a brief resume of the case giving the nature of the illness, its symptoms, causes and duration."

Two things in that note are often skipped at a busy OPD: the probable duration, and the brief case summary. The patient's employer may not ask for the summary, but the form expects it and the register copy is where you show it existed. Sick leave certificate or fitness certificate: what is the difference?

A pre-employment or sports "fitness certificate" is a different document from the return-to-duty certificate above. Appendix 2 is written for leave and rejoining. For any other purpose, the body asking for the certificate usually sets its own format; ask for it and certify only what you examined.

Can a doctor issue a certificate without examining the patient?

The forms answer this themselves. Appendix 2 begins "after careful examination of the case". Form 4 of the CCS (Leave) Rules begins "after careful personal examination of the case". Form 5 says "we / I have carefully examined" the employee and "examined the original medical certificate(s) and statement(s) of the case". Signing any of them without the examination makes a statement on the face of the certificate untrue. Clause 7.7 then applies: any registered practitioner "shown to have signed or given under his name and authority any such certificate, notification, report or document of a similar character which is untrue, misleading or improper, is liable to have his name deleted from the Register."

Requests by phone from a regular patient, or from a relative on behalf of an employee, are the common trap. The rule does not carve out an exception for a patient you know well.

Can a medical certificate be backdated?

No clause uses the word "backdate", so here is what the texts do say. Appendix 2 has two separate dates: the period of absence "with effect from" a date, and the "Date" at the foot when you sign. The leave paragraph certifies what you found "after careful examination". In our reading, the form lets you state from when, in your judgement, the illness required absence, while the date of issue at the foot is the day you actually examine and sign. A certificate whose date of issue is earlier than the day it was written states something untrue, and clause 7.7 and section 234 of the BNS both turn on untrue statements. If a patient comes in after the illness, write the real date of examination and, if you certify the earlier period at all, record in the register what that judgement was based on. When in doubt, ask your state medical council; the state medical councils list has their contacts.

Which certificate will a central government office accept?

The Central Civil Services (Leave) Rules, 1972, in the DoPT's compilation updated as on 24 September 2024, set out who may certify for central government servants. Rule 19(1), as substituted by DoPT Notification No. 13026/1/2002-Estt. (L) of 15/16 January 2004, says:

  • A gazetted officer's application for leave on medical certificate goes with "a Medical Certificate in Form 3 given by a doctor in a Central Government Health Scheme Dispensary if such a Government servant is a Central Government Health Scheme beneficiary or by a Government Hospital or by an Authorized Medical Attendant if he is not" a CGHS beneficiary, or by an authorised doctor of a CGHS- or CS(MA)-recognised private hospital for hospitalisation or indoor specialised treatment.
  • A non-gazetted employee's application goes with "a Medical Certificate in Form 4" from a CGHS dispensary for CGHS beneficiaries, or from a Government Hospital or Authorised Medical Attendant for others, with the same recognised-hospital route.
  • A non-gazetted CGHS beneficiary who falls ill away from the CGHS area or on duty outside headquarters may produce Form 4 or Form 5 from an Authorised Medical Attendant "or by Registered Medical Practitioner if there is no Authorized Medical Attendant available within a radius of eight kilometers from his residence or place of temporary stay", or when it is difficult to get one from a CGHS doctor or AMA.
  • For non-gazetted staff, a certificate from a registered Ayurvedic, Unani or Homoeopathic practitioner, a registered dentist for dental ailments, or an honorary medical officer "may also be accepted" if the state government where the employee falls ill accepts such certificates from its own employees.

Form 4 itself is signed by the "Authorized Medical Attendant … Hospital / Dispensary or other Registered Medical Practitioner". Its notes say the nature and probable duration of illness should be specified, that the form should be filled in "after the signature of the Government servant has been taken", and that the certifying doctor "is not at liberty to certify that the Government servant requires a change from or to a particular locality" unless the administrative authority asks.

Three more parts of rule 19 explain why an office may still ask questions after you sign. Rule 19(3) lets the leave authority get a second opinion from a Government Medical Officer "not below the rank of a Civil Surgeon or Staff Surgeon". Rule 19(5) says the certificate "does not in itself confer upon the Government servant concerned any right to leave". Rule 19(6) lets the authority waive a certificate for leave "not exceeding three days at a time", but such leave is then not treated as leave on medical certificate.

To return to work, rule 24(3)(a) says an employee on leave on medical certificate "may not return to duty until he has produced a medical certificate of fitness in Form 5". For a gazetted officer, rule 24(3)(b) requires a Medical Board, except where the leave is for not more than three months or the Board has said a fresh appearance is not needed. Form 5's signatory line includes "Registered Medical Practitioner", and it asks the signer to certify having examined the original leave certificates. State government employees, banks, PSUs and private employers follow their own service rules, which are often modelled on these; ask the patient for the employer's form.

What does the law say about a false medical certificate?

There are two tracks, and they run independently. The professional track is clause 7.7, quoted above: deletion from the register for a certificate that is "untrue, misleading or improper". A complaint goes to your state medical council, which holds an enquiry and hears you under clause 8.2.

The criminal track is the Bharatiya Nyaya Sanhita, 2023 (Act 45 of 2023, published in the Gazette on 25 December 2023), which repealed the Indian Penal Code by section 358. Section 234 reads:

Whoever issues or signs any certificate required by law to be given or signed, or relating to any fact of which such certificate is by law admissible in evidence, knowing or believing that such certificate is false in any material point, shall be punished in the same manner as if he gave false evidence.

Section 234, Bharatiya Nyaya Sanhita, 2023: issuing or signing false certificate

Section 235 applies the same punishment to whoever "corruptly uses or attempts to use any such certificate as a true certificate, knowing the same to be false in any material point", which is the patient's side of the same act. The punishment for false evidence is in section 229: up to seven years and a fine of up to ₹10,000 where the false evidence is in a judicial proceeding, and up to three years and a fine of up to ₹5,000 in other cases. A BNS-to-IPC correspondence table published on the Kerala Prisons department website maps BNS section 234 to IPC section 197 and BNS 235 to IPC 198, with "No change" in the wording.

Note the mental element in section 234: "knowing or believing" the certificate is false in a material point. An honest clinical judgement that later proves wrong is a different thing from certifying an illness you did not find. Clause 7.7 is wider, because "misleading or improper" does not need knowledge of falsehood.

Does the registration number have to be on every certificate?

Yes. Clause 1.4.1: "Every physician shall display the registration number accorded to him by the State Medical Council / Medical Council of India in his clinic and in all his prescriptions, certificates, money receipts given to his patients." Appendix 2 has a "Registration No." line under the signature, with the name of the council. Clause 7.3 lists not displaying the number on certificates as misconduct. Print it on the certificate pad so it is never left out on a busy day.

Checklist before you sign a certificate

  1. You have examined the patient today, and the visit is recorded.
  2. The patient has signed or put a thumb mark on the certificate, in front of you.
  3. Address and at least one identification mark are on the certificate (1.3.3).
  4. The illness, its probable duration, the period of absence and its start date are filled in (Appendix 2 note).
  5. The date at the foot is today's date.
  6. Your signature, registration number and council's name are on it (1.4.1).
  7. If the employer has its own form (Form 4 or Form 5 for central government staff), you have used it and you are a permitted signatory under rule 19.
  8. The register entry and the copy are made before the patient leaves.

Questions

Is a register of medical certificates mandatory for doctors?

Yes. Clause 1.3.3 of the 2002 conduct regulations says a registered medical practitioner "shall maintain a Register of Medical Certificates giving full details of certificates issued" and keep a copy of each certificate. The certificate itself must carry the patient's signature or thumb mark, address and at least one identification mark, and follow the Appendix 2 form.

Can a private doctor give a medical certificate for central government leave?

Under rule 19 of the CCS (Leave) Rules, 1972, a CGHS beneficiary's certificate comes from a CGHS dispensary, and others' from a Government Hospital or Authorised Medical Attendant. A registered medical practitioner's Form 4 or Form 5 is accepted for a non-gazetted CGHS beneficiary away from the CGHS area when no AMA is within eight kilometres, or one is hard to reach.

What is the punishment for a doctor issuing a fake medical certificate?

Clause 7.7 of the 2002 regulations makes the doctor liable to have their name deleted from the medical register. Section 234 of the Bharatiya Nyaya Sanhita, 2023 punishes issuing a certificate known or believed to be false in a material point as if it were false evidence; section 229 sets up to three years and a fine in non-judicial cases.

Should a sick leave certificate mention the diagnosis?

Appendix 2 has the line "is suffering from" and a note that "the nature and probable duration of the illness should also be specified". Form 4 under the CCS (Leave) Rules repeats that the nature and probable duration should be specified. The form also expects a brief case summary to accompany it.

Can I issue a medical certificate over the phone?

Appendix 2 starts "after careful examination of the case", and Form 4 "after careful personal examination". Certifying without the examination the form describes makes the certificate untrue, which clause 7.7 treats as grounds for removal from the register. If you consult by video, record what you examined and how.
